Mobile App Terms

These Mobile App Terms apply to your use of the Saeve mobile apps for Android and iOS (the "App"), operated by SAEVE.APP ("Saeve", "we", "us", "our").
The App is part of the Saeve service, so our main Terms and Conditions apply to it in full. These Mobile App Terms add only what is specific to the App. If the two conflict on something about the App, these Mobile App Terms prevail. How we handle personal data in the App is explained in our Mobile App Privacy Policy.
By downloading, installing or using the App, you agree to these Mobile App Terms and to the main Terms and Conditions.
1. Who may use the App
The App is for Restaurant Owners and their authorised staff to manage restaurants and menus on Saeve. You must be at least 18 years old and have a Saeve account. The eligibility and account rules in the main Terms and Conditions apply.
2. Licence to use the App
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely to use the Saeve service under these terms.
- On iOS, you may use the App only on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- On Android, you may use the App as permitted by the Google Play Terms of Service.
You must not copy, modify, distribute, sell, rent or lease the App; reverse-engineer it or attempt to extract its source code, except where the law expressly permits this; or use it to breach the acceptable-use rules in the main Terms and Conditions.
3. Updates, availability and data charges
- We may release updates to fix problems, improve security, or change features. Some updates may be required to keep using the App.
- The App needs an internet connection. Your mobile operator's data charges may apply.
- We may stop supporting older App versions, operating-system versions or devices.
4. Purchases
If the App offers paid plans or purchases, they are subject to Section 8 of the main Terms and Conditions. Any purchase made through the Apple App Store or Google Play is also subject to that store's payment terms, and its refunds are handled by that store under its own refund policy.
5. Ending your use
You can stop using the App at any time by uninstalling it. Uninstalling the App does not delete your Saeve account. To delete your account and its data, follow Section 7 of the Mobile App Privacy Policy.
We may suspend or end your access to the App for the reasons set out in the main Terms and Conditions. When your access ends, your licence to use the App ends too, and you must stop using it.
6. Additional terms for the Apple App Store
If you downloaded the App from the Apple App Store:
- Parties. These terms are between you and Saeve only, not Apple. Saeve, not Apple, is solely responsible for the App and its content.
- Maintenance and support. Saeve alone is responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support for the App.
- Warranty. To the extent any warranty applies by law, if the App fails to conform to it, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are Saeve's responsibility, subject to the main Terms and Conditions.
- Product claims. Saeve, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it. These include product-liability claims; claims that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer-protection, privacy or similar laws.
- Intellectual property. If a third party claims that the App, or your possession and use of it, infringes their intellectual-property rights, Saeve, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms (for example, your mobile data provider's) when using the App.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
7. Additional terms for Google Play
If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. These terms are between you and Saeve only, and Google is not responsible for the App or its content.
8. Everything else
Ownership of your content, menu-accuracy responsibility, disclaimers, limitation of liability, indemnity, changes to the terms, governing law and disputes are covered by the main Terms and Conditions, and apply to the App in the same way.
